Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Mova (the “Service”). By accessing or using the Service, you agree to these Terms.

1. Who We Are

Mova is a progressive web app for learning Ukrainian language and related cultural content.

2. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

3. Accounts and Security

  • Account: You may need an account (for example, via Firebase Authentication) to access certain features.
  • Security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • Accurate information: You agree to provide accurate, current information and to keep it updated.

4. Subscriptions, Payments, and Trials

Some features may require a paid subscription (“Pro”). Payments are processed by our third-party payment processor (e.g., Stripe). By purchasing Pro, you agree to:

  • Billing terms: The price, billing interval, and renewal terms presented at checkout.
  • Automatic renewal: Unless you cancel, your subscription renews automatically.
  • Taxes: You are responsible for applicable taxes unless stated otherwise.
  • Refunds: All sales are final. We do not provide refunds for prior payments except where required by law.

You may cancel at any time to stop future billing, but payments already made are not refunded. If you believe you were charged in error, contact support@mova.app.

You can manage or cancel your subscription via the billing portal (when available) or through the platform you used to subscribe.

5. Acceptable Use

You agree not to misuse the Service. For example, you will not:

  • Attempt to access or probe non-public systems or parts of the Service.
  • Interfere with or disrupt the Service, including by introducing malware.
  • Reverse engineer the Service except where prohibited by law.
  • Use the Service in violation of applicable laws or regulations.
  • Use automated methods to scrape, harvest, or extract data at scale.

6. Content and Intellectual Property

  • Our content: The Service, including its software, design, text, graphics, audio, and other materials, is owned by Mova or its licensors and is protected by intellectual property laws.
  • Limited license: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial learning purposes, subject to these Terms.

7. User Content

The Service may allow you to submit content (for example, profile information, notes, or feedback) (“User Content”). You retain ownership of your User Content. You grant Mova a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting only), and display your User Content as necessary to operate and improve the Service.

8. Educational Nature; No Professional Advice

The Service is provided for educational purposes only and does not constitute professional advice. We do not guarantee that your language outcomes will meet any specific standard, exam, or proficiency level.

9. Offline Use and Device Storage

The Service may support offline functionality through a service worker and local device storage. Some data may be cached on your device to improve performance and offline access. You are responsible for maintaining your device and backups.

10. Third-Party Services

The Service may integrate with third-party services (for example, Firebase for authentication/data storage and Stripe for payments). Your use of third-party services may be subject to their terms and policies. We are not responsible for third-party services.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms, if we are required to do so by law, or to protect the Service or other users. You may stop using the Service at any time.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW,Mova DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mova WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED TO OR THROUGH THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless Mova from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Service or your violation of these Terms.

15. Changes to the Service or Terms

We may change the Service and these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by posting an updated effective date or via an in-app notice). Your continued use of the Service after changes become effective means you accept the updated Terms.

16. Governing Law; Disputes

These Terms are governed by the laws of the jurisdiction where Mova is headquartered, excluding conflict of law rules. Venue for disputes will be in the courts located in that jurisdiction, unless applicable law provides otherwise.

18. Miscellaneous

  • Severability: If any provision is held unenforceable, the remaining provisions remain in effect.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
  • Entire agreement: These Terms are the entire agreement between you andMova regarding the Service.
